Terms of Service

These Terms of Service ("Terms") govern your use of Echolify and its product MyEcho, operated by IN-CONTEXT LLC, a Texas limited liability company ("we," "us," "our"), including myecho.echolify.ai, echolify.ai, and any echo you create or embed elsewhere (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

MyEcho lets you build an "echo" — an AI chatbot that answers questions using facts, tone, and content you provide about yourself or your business — and share it via a public link or embed it on your own website. Paid plans also include Nico, a private AI workspace at assistant.echolify.ai — separate and sign-in-protected, for documents you do not want your echo to know about, from which you can choose to publish individual facts to your echo. Features, limits, and pricing may change, and the Service may be interrupted or discontinued at any time.

2. Accounts

You must provide accurate information when you sign up and are responsible for keeping your password confidential and for all activity under your account. You must be at least 13 years old to use the Service. If you're using the Service on behalf of a business, you're representing that you have the authority to do so and that the business agrees to these Terms.

3. Your content

You retain ownership of the persona content, documents, and other material you upload ("Your Content"), including anything you upload to Nico. By submitting Your Content, you grant us a license to store, process, and display it as needed to operate the Service — for example, to send it to our AI provider to generate replies, or to show it to visitors on your public link. Content in Nico is private by default and is displayed publicly only where you have explicitly published it. You're responsible for making sure Your Content doesn't infringe anyone else's rights and doesn't include information you're not authorized to share.

4. Acceptable use

You agree not to use the Service to:

• Impersonate a real person or business without their consent, or otherwise mislead visitors about who or what they're talking to.
• Upload or generate unlawful, defamatory, harassing, or infringing content.
• Attempt to bypass rate limits, usage budgets, or other technical restrictions.
• Use the Service to build a competing product, or to extract data at scale beyond ordinary use.
• Upload sensitive personal information (such as Social Security numbers, financial account details, or health information) about yourself or others into your echo's persona content.

5. AI-generated content

Replies from an echo are generated by an AI model based on the content its owner provided. Replies may be inaccurate, incomplete, or out of date, and do not necessarily reflect the views of the person or business the echo represents. Don't rely on an echo's replies for medical, legal, financial, or other decisions requiring professional advice.

6. Public sharing and embedding

Content you make available through your public link, QR code, or website embed can be viewed and messaged by anyone who has access to it. You control what you put into your persona — don't include anything you don't want visible to the public. The same applies to anything you publish from Nico: publishing makes that fact readable, in plain text, by anyone who has your share link, until you unpublish it.

If you embed your echo on your own website, or otherwise put it in front of your customers or visitors, you are responsible for making clear to them that they are talking to an AI chatbot rather than a live person, and for meeting any AI-disclosure or automated-chat disclosure requirements that apply where those visitors are. Don't configure, name, or describe your echo in a way designed to make someone believe they're talking to a human.

7. Fees

The core Service is free to use, subject to daily usage limits. MyEcho Pro (for a Personal echo) and MyEcho Business Pro (for a Business echo) are optional paid subscriptions that raise your daily limit both for your own test-chat and for visitors chatting with your public link, and include access to Nico. Each paid plan includes a set daily usage allowance — separately for your own test-chat and for each visitor chatting with your link; once an allowance is reached, chat pauses until it resets the next day, and there are no overage charges. Payments are processed by Stripe — see our Privacy Policy for what data that involves. Subscriptions renew monthly and bill automatically until cancelled. You can cancel anytime from your account; cancellation takes effect at the end of your current billing period, and you keep paid access until then. We don't provide refunds for partial billing periods. We may change a plan's price or features with notice before the change applies to your next billing cycle.

Promotional access. We sometimes issue promo codes that unlock a paid plan on an account for a limited period, at no charge and with no card or subscription. Promotional access carries its own daily usage allowance, which may differ from the allowance included with that plan when purchased. It ends automatically on the date shown in the app, creates no subscription and renews into nothing — when it ends, the account returns to the free plan and its limits, and nothing you created is deleted. A code is issued for use on the account that redeems it, is not transferable and has no cash value, and we may deactivate a code, or withdraw or shorten promotional access, at any time.

8. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms, or discontinue the Service (or any part of it) at our discretion, with notice where reasonably practical.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, IN-CONTEXT LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 12 months before the claim arose.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, unless otherwise required by the law of your place of residence. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state or federal courts located in Texas.

12. Changes to these Terms

We may update these Terms as the product changes. We'll update the "Last updated" date above when we do; continued use of the Service after changes take effect means you accept the updated Terms.
